Introduction

  • The usage of CareerLMS Website/LMS (“The Service” or “The Platform”) is governed by the following terms and conditions (“Terms of Service”), so please read them carefully.
  • By using CareerLMS services you agree to abide by these terms and conditions completely.
  • CareerLMS holds the authority to update the Terms of Service at any point of time without any formal notification. Inclusion of any new feature or tool may affect the Terms of Service and continuance of your usage solely depends on your agreement with the changes in the most current version of the Terms of Service.
  • Violation or disagreement with the Terms of Service at any point of time will result in termination of your service/account.
  • To become a registered user of the platform it is mandatory to agree with CareerLMS’s Terms of Service.

User Account

  • You need to be a human aged 18 years or more to use CareerLMS Services (account creation by a bot or any other automated means is not acceptable). By agreeing to the Terms of Service, you warrant that your age is 18 or above.
  • The Service is not available to minors and to accounts suspended or prohibited for any violation of the usage policy.
  • You as a user do not have the permission to sell, trade or transfer your CareerLMS account.
  • You are bound to provide current and accurate information about yourself (name, age, contact details, etc.) as and when requested by the system or during the signup process.
  • You are solely responsible for maintaining the confidentiality of your username and password. CareerLMS will not be liable for any damage or loss caused due to user’s failure in meeting the security obligations.
  • You are accountable for any activity (uploads, deletion, content updates, etc.) carried out using your login credentials.
  • An individual user cannot have more than one active account and should not use pseudo user details to register for a trial version. Sharing of same login credentials by multiple individuals is not allowed.

Content

  • You understand and agree that CareerLMS cannot be liable for the content published by you on the Service.
  • Any content (including but not limited to text, graphics, images, audios, videos, audio-visual material, scripts, software and files) accessible to you as a user is CareerLMS’s proprietary property with all rights reserved. You are not allowed to modify, copy, distribute, reproduce, post, transmit, frame, republish, download, display, or sell it in any form via any means, completely or partially.
  • Any content (including but not limited to text, graphics, images, audios, videos, audio-visual material, scripts, software and files) uploaded by you on the platform should not be illegal or unlawful. You must not violate the copyright, trademark, privacy, or other personal or proprietary rights of any third party via CareerLMS Platform. CareerLMS cannot be held responsible for any such violation by the user at any point of time.
  • CareerLMS does not pre-scan the content included by its users. Thus any content material found unlawful, harmful, offensive, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable material of any sort can be eliminated from the platform (whenever detected) in CareerLMS’s sole discretion.
  • You cannot use the Platform to upload any content that may introduce viruses, worms, trojan horses, time bombs or bots that may influence the Platform’s performance, or interfere with anyone’s network or computer system.
  • The Platform is capable of examining user data and generate analytics. By using the Platform you permit CareerLMS to draw insights based on your data.
  • You must not use the Platform to propagate any unsolicited messages or spam email.

Warranty

  • The Service and associated materials are provided on an “as-is” and “as available” basis. Though CareerLMS takes all possible measures to keep the Platform safe, functional and error-free, it does not warrant or represent:
    • The completeness or accuracy of the service
    • The service will fit a specific purpose or requirement (without any modification)
    • The service will be error-free, timely, secure or uninterrupted
    • The quality of any information, services or the product itself will match your expectations
    • Any errors on the platform/in the product will be corrected
  • CareerLMS disclaims all warranties, expressed or implied, including but not limited to implicit warranties of merchantability and fitness for a particular purpose, or non-infringement of intellectual property.
  • You understand and agree that any content downloaded or obtained while using the Service is at your own discretion and risk. You will be solely responsible for any loss or damage caused to your system due to the download of any content from the Platform. CareerLMS shall not be responsible for any loss or damage caused or alleged to have been caused, directly or indirectly, by the information or ideas enclosed, recommended or referenced in or appearing on the Platform.
  • Your participation on the Platform is solely at your own risk. By using the Service, you acknowledge that your usage of the Service is at your sole risk.
  • CareerLMS includes third party integrations and external links but it does not take responsibility for any third party application or content. The usage outside CareerLMS domain is subject to the policies and T&Cs of the third party.

Payment

  • Free trial needs completion of registration process on the platform but no Credit Card details are required.
  • For premium account holders it is mandatory to provide current and correct Credit Card details.
  • There is no refund policy for any transaction carried out via any mode of payment. No refund will be processed under any circumstances.
  • Pricing may be updated with the introduction of any additional feature or service and billing will be processed accordingly. CareerLMS will inform you about any pricing updates and the date from which it will be applicable, by sending an email to your registered email id.
  • CareerLMS doesn’t provide refunds for the payments made online and via cash. We setup the complete infrastructure for the Institute who signup to use CareerLMS initially and this is the one of the primary reasons why CareerLMS won’t be able to provide a refund for the payments made.

Termination

  • If you are not satisfied by CareerLMS Services, then cancellation of account can be done by dropping an email at [email protected]. Your access to the Platform will be terminated by CareerLMS Support.
  • If you decide to terminate the Service before the end of your current paid month then your billing will be processed at the end of the current month and you won’t be charged henceforth.
  • CareerLMS has the right to terminate or suspend your account, delete your profile or any information provided by you, at any point of time for any reason or no reason. Such deactivation will restrict you from any future access to your account and may result in forfeit of all the content linked with your account.
  • CareerLMS reserves the right to deny Services to any individual or group at any point of time for any reason.
  • CareerLMS offers a free trial version allowing users to try the product. Any free account will automatically get deactivated once the trial period is over, and if no transaction or purchase is done by the user.

Communication

  • By using the Service, you agree to receive any communication via email, call or SMS from CareerLMS regarding account information, activity, product upgrade and reminders.

Limitation of liability

  • In any event, CareerLMS shall not be liable to the user or any third party for any incidental, indirect, special, punitive, or consequential damages (including but not limited to Business Interruption, Loss of Data, Usage, Business or Revenue) arising out of or associated with the use of The Platform.

Intellectual Property

  • CareerLMS does not claim any intellectual property rights over the content and material provided by you to the service. Your profile data, as well as any content provided by, will remain yours.
  • You must respect CareerLMS’s intellectual property rights as well as those of any third party involved.
  • All rights to the Service (including but not limited to content, documentation, designs, text, graphics and other files) shall remain the sole and exclusive property of CareerLMS.
  • Copying, modifying, distributing, reproducing, or reverse assembling any parts or whole of the CareerLMS product by any means is not acceptable under any circumstances. If you encounter any such breach or infringement you must communicate it to CareerLMS immediately.

General

  • CareerLMS promotes transparency in all its processes and transaction and expects the user to provide accurate information (including but not limited to contact information, fee structure, date of creation, batch size, mode of study and enrollment) about the courses created using the Platform.
  • Headings used in the document are just used for convenience and to enhance readability and should not be termed for any meaning or intent.
  • CareerLMS promotes transparency in all its processes and transaction and expects the user to provide accurate information (including but not limited to contact information, fee structure, date of creation, batch size, mode of study and enrollment) about the courses created using the Platform.
  • Technical support is available only for premium/paid accounts.
  • You recognize that Platform involves third party tools and hosting partners to facilitate the essential hardware, software, networking and storage.
